Rapist sentenced to 7 yrs RI

IMPHALm 17th Oct: Special Judge POCSO, Imphal West on Thursday sentenced Hemam Rajesh, who was convicted of sexually assaulting a 7-year old girl, to seven years rigorous imprisonment and imposed a fine of Rs 15,000.
During the sentence hearing on Thursday, the Special PP said that Hemam Rajesh (28) of Moirang Konjengbam Leikai was convicted of kidnapping, wrongful concealing or keeping in confinement and sexual assault of a minor under Section 366 & 368 of IPC and Section 4 of POCSO. As such, he appealed to the Court to sentence the convict to a minimum of 10 years in prison.
The defence counsel argued that as the convict is a poor young man, proper rehabilitation and guidance could help him lead a normal life. In addition, he has no previous criminal records, the counsel maintained and appealed to the Court to reduce the penalty.
Convict Hemam Rajesh also conveyed to the court about his family background, stating that his father had died and his mother remarried another man. Despite being the only son, he never got any schooling and earned his livelihood by working at a workshop. He then appealed to the Court to show him mercy. After listening to arguments of both parties, the Court sentenced Rajesh to 7 years rigorous imprisonment each under Section 366 & 368 of IPC and Section 4 of POCSO, all to be served concurrently. It further ordered him to pay a fine of Rs 5000 under each of the Sections, amounting to a total of Rs15,000, failing which he would have to serve additional jail time of 3 months each. It also stated that the time the convict had spent in jail during investigations and the trial, would be commuted from the total sentence period. The court further stated that 80 percent of the fine would be handed over to the victim as compensation, while also directing the authorities concerned to give the necessary compensation to the victim under the Manipur Victim Compensation Scheme.
