Charges framed against 10 cops
IMPHAL, 16th Sep: In connection with the fake encounter/extra judicial killings of 6 people by a combined team of Imphal West commandos and 12 Maratha Light Infantry on the intervening night of September 7 and 8, 2009 at Awang Khunou; Special Sessions Judge Imphal West has framed charges against 10 police personnel including the then sub-inspector Irengbam Khaba.
During the hearing of the case on Monday, the Court, after listening to the arguments of the prosecution and defence counsel, held that charges against the accused persons could be framed under Section 304 (read with 34 and 201 of IPC) and proceeded to do so. However, the accused persons pleaded not guilty, following which the Court fixed the first hearing of the case on October 1 for recording the testimony of the first prosecution witness.
According to the chargesheet submitted by the IO of CBI, a combined team of Imphal West commandos and 12 Maratha Light Infantry carried out fake encounter of 6 persons in two separate incidents at two different locations. The names of the deceased persons mentioned in the chargesheet are Ksh Gobin (A mobile recharge vendor), Ngaseppam Dany (Betel Shop vendor), Md Tomba (Rickshaw puller), Ak Oken (taxi driver), Md Mujibur Rahman (taxi driver) and Md Azgar Ali (an Assamese trader). On top of this, Imphal West District commandos fired 119 bullets while the 12 Maratha Light Infantry fired 98 bullets.
However, only 12 shell casings were recovered from the crime scenes, of which only three bullets matched with the bullets found embedded on the deceased persons.
The chargesheet further mentioned that former Subedar I Khaba rearranged the crimes scenes and hid the weapons before the arrival of the IO of the case SI Kh Devkumar (Patsoi PS).
As such, the IO made a prayer to the Court to issue summons to the 10 personnel mentioned in the chargesheet to initiate the trial proceedings of the case.
